Terms of Service

1. Who we are

These Terms of Service ("Terms") form a binding agreement between you and Witty English ("we", "us", "our"), operator of the WITTY ENGLISH vocabulary service (the "Service"). By creating an account, paying for a plan, or using the Service, you agree to these Terms.

2. Acceptance and eligibility

Continued use of the Service constitutes acceptance of these Terms. You must be of legal age in your jurisdiction; if using on behalf of an organization, you represent that you have authority to bind it.

3. The Service

WITTY ENGLISH is a spaced-repetition vocabulary tool with AI-assisted definitions, examples, mnemonics, quizzes, and a "Sentence Lab" writing check. The Service is provided as-available and we may add, change, or remove features at any time.

4. Accounts and account security

You are responsible for keeping your account credentials confidential and for all activity under your account. Keep your registration information accurate and notify us promptly of any unauthorized use.

5. Acceptable use

You agree not to:

• use the Service for unlawful, fraudulent, or deceptive purposes;
• send spam or impersonate others;
• infringe anyone's intellectual property, privacy, or other rights;
• upload, generate, or distribute malware or harmful code;
• probe, scan, scrape, reverse engineer, or interfere with the Service's security or availability;
• resell, redistribute, or circumvent technical limits or paid features.

6. AI-generated content

WITTY ENGLISH uses AI models to generate definitions, examples, mnemonics, and feedback. You are responsible for your prompts, for how you use the outputs, for verifying their accuracy, and for having the rights to any content you submit. Do not use the Service to generate illegal content, deepfakes, hate speech, malware, or jailbreak content. Outputs may be inaccurate or incomplete and are not a substitute for professional advice. We may filter, refuse, remove, or restrict content and may suspend accounts for repeated or serious violations.

7. Your content

You retain ownership of the decks, words, and sentences you create. You grant us a limited, worldwide, non-exclusive license to host, store, and process this content solely to operate and provide the Service to you.

8. Our intellectual property

We retain all rights in the Service, including its software, design, branding, and documentation. We grant you a limited, non-exclusive, non-transferable right to use the Service within your plan for personal or internal business use.

9. Payments and refunds

WITTY ENGLISH's paid plan is a one-time lifetime purchase — no subscription, no automatic renewal. Payment is made via bank transfer; after transfer, contact us on our KakaoTalk 1:1 channel with your account email and we'll upgrade your account. See our Refund Policy (within 7 days of purchase, paid features unused).

10. Service availability and warranties

We work hard to keep the Service running but do not guarantee that it will be uninterrupted, timely, secure, or error-free. To the fullest extent permitted by law, the Service is provided "as is" and we disclaim all implied warranties, including merchantability, fitness for a particular purpose, and non-infringement.

11. Limitation of liability

To the fullest extent permitted by law, we will not be liable for indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, or goodwill. Our aggregate liability will not exceed the fees you paid to us in the twelve (12) months preceding the event giving rise to the claim. Nothing here excludes liability that cannot be excluded by law.

12. Indemnity

You agree to indemnify and hold us harmless from claims or damages arising out of your content, your unlawful use of the Service, or your breach of these Terms.

13. Suspension and termination

We may suspend or terminate your access for material breach, non-payment, suspected security or fraud risk, or repeated policy violations. On termination, your right to use the Service ends immediately; content is retained or deleted per our Privacy Notice.

14. Changes to the Service or Terms

We may update the Service or these Terms from time to time. For material changes we will provide reasonable notice (in-app or email). Continued use after the effective date constitutes acceptance.

15. Governing law and disputes

These Terms are governed by the laws of the Republic of Korea. Disputes will be brought in the competent Korean courts, subject to mandatory consumer-protection law.

16. Assignment and force majeure

You may not assign these Terms without our written consent. We may assign in connection with a merger, acquisition, or sale of assets. Neither party is liable for delay or failure caused by events beyond its reasonable control.
